In a move that I wouldn't be surprised to see repeated in the near future in the Magnolia State, Governor Rick Perry of Texas declared today that he [won't be implementing Obamacare][1] in Texas. Specifically, he says the state will not increase its Medicaid roles to cover additional working poor with the program, and the state will not set up the state exchange that's required in the law.

Perry's office sent a letter to U.S. Health and Human Services Secretary Kathleen Sebelius on Monday morning asserting his opposition, both to accepting more than a hundred million federal dollars over the next several years to put more poor Texas adults onto Medicaid, and to creating an Orbitz-style online insurance marketplace for consumers.marketplace for consumers.

The story notes that the insurance exchange isn't optional, and that the Federal government will set up a "one size fits all" exchange for the state.

“If anyone was in doubt, we in Texas have no intention to implement so-called state exchanges or to expand Medicaid under Obamacare," Perry said in a statement. "I will not be party to socializing healthcare and bankrupting my state in direct contradiction to our Constitution and our founding principles of limited government."

Texas, according to the story, has the country's highest percentage of uninsured residents.

But Dan Stultz, president and CEO of the Texas Hospital Association, said without the expansion, "many will remain uninsured, seeking care in emergency rooms, shifting costs to the privately insured, and increasing uncompensated care to health care providers."

And for folks who think the current ACA is a "socialist" expansion, does anyone find it curious that conservative leaders would leave their state exchanges to the Federal government to set up? It seems you would want a hand in there, making sure free market principles reign and such.

Although I guess stamping your feet and say "No! No! No!" feels like better politics to Governor Perry.

Augusta National Golf Club announced today that the club will welcome its first two female members when the club opens for its new season in October. For years, the home of The Masters has resisted allowing women to join the private all-male golf club.

Former Secretary of State Condoleezza Rice and South Carolina financier Darla Moore have accepted to join the club and will be the first female members to don a green jacket in the club’s history. This move has been coming since 2002.

Martha Burk of the National Council of Women's Organizations wanted the club to add women members in 2002 and lead a small boycott of the 2003 Masters tournament. Former club chairman Hootie Johnson, chairman during Burk’s protest, dug his heels in once saying Augusta National might one day have a woman in a green jacket, "but not at the point of a bayonet."

The Masters lost television sponsorship for two years and the club paid CBS to broadcast the tournament commercial free for those two years. Johnson retired in 2006 and Billy Payne has been more open to allowing women than his predecessor.

"These accomplished women share our passion for the game of golf and both are well known and respected by our membership," Payne said in a statement. "It will be a proud moment when we present Condoleezza and Darla their green jackets when the club opens this fall. This is a significant and positive time in our club's history and, on behalf of our membership, I wanted to take this opportunity to welcome them and all of our new members into the Augusta National family."

In the ESPN article linked above, it states from private sources that women have been considered for membership five years ago. It is about time, Augusta National added women members and hopefully these two women will not be the only female members added.

5. Pi(e) Lounge at Sal & Mookies (Fondren) is inviting people to come there and watch. Probably a mixed group, politics wise, but we wouldn't expect many birthers. The cocktails will flow freely.

The 29th Annual Fannie Lou Hamer Memorial Symposium starts tonight at the Fannie Lou Hamer National Institute on Citizenship and Democracy at Jackson State with a keynote address by Dr. Mary Coleman at 6:30 p.m. in the Dollye M.E. Robinson College of Liberal Arts and will be followed by a debate watch tonight and will continue throughout the day tomorrow. We're guessing that the punchbowl won't be spiked. Go ready to think and be sick and tired of being sick of tired in honor of the great Mrs. Hamer.

7. Watch the debate at the Top Notch Sports Bar at 109 Culley Drive. We don't know their politics--football?--but clearly you can get a beer. It's a sports bar, fool.

Johnny Lee Butts went out for his regular morning walk on July 22, 2012 and never came home. That morning, a car struck and killed Butts; later police arrested a couple of teenagers for the crime.

In a recent report, CNN shed new light on what happened that morning . According to statements by two of the passengers-- a teenager and a man named Tony Hopper Jr.-- the passengers and unnamed driver of the car spotted a man walking. Here's an exchange from the grand jury indictment, according to CNN:

We see a walker on the side of the road. The complete left side of the road while we are on the complete right side of the road," the unidentified teen told a police lieutenant. "And I pointed out to say, 'watch out there is a walker there...'" The unnamed teen continued his story: "Whit slightly turns the steering wheel and I saw him. 'Watch out, don't do nothing stupid' and then he just keep turning the steering wheel and eventually before we knew it he ran him straight over." "He didn't slow down," Hopper said in a statement to a deputy sheriff. The deputy asked: "He never hit his brakes?" Hopper replied: "No sir." "Do you think he hit him on purpose?" asked the deputy. "Yes, sir, I do," said Hopper.

The driver is white; Butts was African American. However, the Panola County District Attorney John Champion (he is also the DA for DeSoto County) opted to not seek hate crime charges in the case.

Donny Butts, the victims brother wants to know why. He told CNN "That's the only reason they ran him over because he was black. Point blank."

The Butts family is considering filing a wrongful death suit, which may be the only way for the full truth to come out.

Mississippi Attorney General Jim Hood's office sent out the following news release this afternoon:

Jackson, MS—A Hinds County resident has been arrested a second time for depraved heart murder, announced Attorney General Jim Hood today.

Tracey Lynn Garner (formerly known as Morris Garner), age 52, of Jackson was arrested Thursday (June 13) by Investigators with the Mississippi Attorney General’s Office Consumer Protection Division Intellectual Property Task Force, with assistance from investigators with the Attorney General’s Cyber Crime Unit, and charged with one count of depraved heart murder.

Garner has been indicted in Hinds County on the recent charges involving the death of a Selma, Alabama resident while Garner was performing a buttocks augmentation. The indictment alleges that Garner, on or about January 13, 2010, “did kill Marilyn Hale…by means of injecting a silicone substance into the body of Marilyn Hale, thereby committing an act eminently dangerous to others and evincing a depraved heart.”

Garner was arrested at his home where he was under house arrest facing charges in another depraved heart murder case involving the death of Atlanta Georgia resident, Karima Gordon, who also allegedly received injections of a foreign and possible counterfeit substance during an illegal buttocks augmentation performed by Garner at his 1020 Peyton Avenue address in Jackson.

“Our intellectual property task force is involved in these cases to investigate the possibility that the substances injected into the victims were a counterfeit version of silicone,” said Attorney General Hood

The Attorney General encourages anyone who may have received a buttocks or breast augmentation from this defendant to please notify the AG’s Consumer Protection Division at 1-800-281-4418.

If convicted of these crimes, Garner faces up to life in prison. As with all cases, the defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

The case is being investigated by Lee McDivitt and Richie McCluskey of the Attorney General’s Consumer Protection Division Intellectual Property Task Force. Prosecution of the case will handled by the division director, Assistant Attorney General Patrick Beasley.

The Mississippi Republican Party has responded to the McDaniel campaign in the form of a statement to the public and a letter to Chris McDaniel's attorney, Mitch Tyner, from Joe Nosef, MS GOP chairman. (Here's the letter in PDF format.)

The upshot is that the MS GOP is suggesting to Tyner that they go ahead and take their fight to court, in part because the MS GOP's executive committee would only have 24 hours starting Aug 13th (once the requisite seven days notice for a meeting was circulated) to figure out whether it makes sense to overturn a U.S. Senate primary result. That's just one day before McDaniel would be forced by law to go to court on Aug 14th.

So, they're punting. (Which sometimes makes sense on Fourth and Forever.)

Jackson, MS. –– Joe Nosef, Chairman of the Mississippi Republican Party, issued the following statement today regarding a challenge to the results of the June 24th primary runoff and a letter sent today by Chairman Nosef to Mitch Tyner, lawyer for the Chris McDaniel campaign:

"Our 52-member volunteer Republican State Executive Committee has been asked to spend just five hours listening to legal arguments and then overturn a United States Senate primary in which over 360,000 Mississippians cast votes.

It is neither prudent nor possible in a single day for any political committee to process and review the significant amount of complex evidence necessary to make such a decision, and attempting to do so would be prejudicial to both candidates.

Under these circumstances, the only way to ensure that the integrity of the Mississippi Republican Party and our election process remains intact is to have a proper, public review of this matter through the judicial system in a court of law. Both candidates have said they look forward to such a review, and now is the time. "

On American Family Radio’s talk show "Focal Point with Bryan Fischer" yesterday, the group's spokesman offered his explanation for the events that have led to the movement in #Ferguson. The policeman who killed 18-year-old Michael Brown did so because, Fischer says, Brown was "hyped up" on marijuana. Fischer cites recent reports that Brown may have had marijuana in his system, making him go "berserk" on the policeman. He also includes reports that Brown was shot six times in his front.

"We know now he did have marijuana in his system," Fischer explained, "and we've had stories, remember, we've had stories from Colorado, people going berserk on marijuana and killing people, hyped up on marijuana. So it's more dangerous than people think."

Not only does Fischer lack evidence to back up his claim that Brown was an aggressor, but, in the words of the late Robin Williams, "Marijuana enhances many things, colors, flavors, sensations, but you are certainly not f***ing empowered."

Speaking of Williams, the Christian right has attacked the actor following his recent death as well. While Rush Limbaugh alluded that Williams' suicide was a result of his liberal worldview, Peter Sprigg of the Family Research Council said Monday that Williams' death justifies gay conversion therapy.

"…Why aren’t you trying to outlaw rehab? I ask the question because such activists are trying to ban a form of mental health treatment—not drug and alcohol rehabilitation, but 'sexual orientation change efforts' ('SOCE'), also known as 'sexual reorientation therapy.'"

Sexual reorientation therapy, or reparation therapy, has nothing to do with the death of the beloved comedian, and it is also considered unscientific and ultimately harmful by the American Psychiatric Association.

But scientific evidence won’t stop organizations like the AFA or the FRC from using death to push an ideological agenda.

The American Family Association has no love for the release of the film "Fifty Shades of Grey” for the upcoming Valentine's Day Weekend.

In a news release today, the Tupelo-based nonprofit threw some shade of its own at the movie, which is based on an E.L. James novel of the same title, calling it sexually graphic and degrading to women.

“Nothing in ‘Fifty Shades of Grey’ builds up society, respects or empowers women or demonstrates healthy relationships,” said AFA President Tim Wildmon in the release. “Rather, the film glorifies abusive relationships and glamorizes abusive tendencies such as stalking, bondage sex, intimidation and isolation."

This sudden gush of concern from the same organization that often disrespects LGBT women (and men) by calling them immoral. AFA also recently said the landmark Roe V. Wade decision, which protects the right of women to have abortion, is tantamount to a "war on women." Reproductive-justice advocates and people possessing a uterus, however, say abortion access empowers women to make decisions about their bodies that can have positive impacts on their lives.

A quick search of the AFA's website turned up no support of, say, equal-pay legislation at either the state or federal level. Also, while the AFA writes frequently on the harms of domestic violence, it's usually in the context of its tirades against the pornography industry and not simply protecting the safety of women.

"A more apt title for the movie would be 'Fifty Shades of Evil,'" Wildmon said in the release. "Without question, this film will have a corrosive effect on cultural views of what normative sexuality ought to be. Healthy relationships seek to safeguard the emotional and physical well-being of another; this film promotes inflicting emotional, physical and psychological harm on another for the sole purpose of self-serving sexual gratification. It is the epitome of elevating abuse, and we call on all theaters to reject promoting such abuse on their screens.”

In the meantime, AFA is supporting a social-media movement, #50DollarsNot50Shades, that encourages potential moviegoers to donate $50 to a local domestic-abuse shelter instead of going to see “Fifty Shades."

So there's that.

Jackson Zoo officials have announced that a pack of feral dogs killed a gazelle and five springbok. Two geese were also hurt. The following is a verbatim description of the incident from the zoo:

Zoo staff discovered the animals had been attacked early Friday morning, and began to take measures of contacting Animal Control and catching the dogs before they attacked any other animals or escaped off property. The Zoo captured four of the five feral dogs believed to be involved in the accident. One dog escaped the premises; along with another dog spotted in the adjoining cemetery, not presently linked to the attack. None of the five medium size mixed breeds were wearing a collar for identification.

"This is a sad day, and the hardest thing about it is it didn't have to happen. The entire zoo's animal care staff work very hard to give the best care to the collection of animals here at the zoo, and to have them killed this way is tragic,” Zoo Director Beth Poff said, “There are people out there who have not taken responsibility for their dogs, and unfortunately we all have to suffer the consequences."

The Zoo lost 5 Springbok and 1 Addra Gazelle from its’ African Savannah area. Both species are part of antelope-gazelle family found in parts of Africa. The two spur-winged geese that were injured have been taken to the Zoo’s Animal Hospital for care.

Through a preliminary investigation there has not been a point of entry found on the fence line. The investigation continues as to where the dogs entered and one dog escaped the premises. The fence line is walked weekly to check for openings where dogs or other predators could enter.

The Zoo has 24-hour security, which has called Animal Control for dog sightings on zoo property eight times in the last five months, only three dogs have been captured from these calls.

Jackson Zoo staff continues to be vigilant in sighting loose dogs and monitoring the containment fences that surround the property. The zoo has contacted the City of Jackson today for assistance in containment, especially around possible drainage areas under the fence line.

A news release from the Mississippi State Department of Health about City of Jackson drinking water is reproduced in its entirety below:

Today the Mississippi State Department of Health– after consultation with the Centers for Disease Control and Prevention and the Environmental Protection Agency, is advising all residents who receive their drinking water from the City of Jackson Water System to take the following precautions:

· Before using tap water for drinking or cooking, run your tap on cold for one to two minutes; for more detailed information visit www.cdc.gov/nceh/lead/tips/water.htm; · Households should never use hot water for drinking or cooking; · Any child five years of age or younger and any pregnant woman should use filtered water (NSF53 certified filter http//info.nsf.org/Certified/DWTU) or bottled water for drinking and cooking; · Baby formula should be “ready-to-feed” or prepared using only filtered water or bottled water; and · Parents with children six years or younger should contact their child’s pediatrician or primary care provider to ensure adequate lead screening and blood testing have been performed.

“Although the majority of home lead testing performed identified no lead, or lead below the action level of 15 ppb, we are issuing these recommendations as a special precaution for young children and pregnant women,” said State Epidemiologist Dr. Thomas Dobbs.

“It’s important to remember simple measures, such as flushing the faucet for one to two minutes, can markedly reduce lead levels in tap water,” added Dobbs.

The Mississippi State Department of Health will mail the above health recommendations about lead to all customers on the City of Jackson Water System, and will closely monitor the City of Jackson’s progress to reduce the corrosiveness of water. Corrosive water leads to leaching of lead in some older homes where plumbing contains lead pipes or lead solder.

“We believe these precautions should remain in place at least six months while the City of Jackson makes the necessary changes required to stabilize the alkalinity and pH levels in the system. These changes should ensure better optimization of corrosion in the Jackson Water System, which should lead to minimal leaching of lead in home plumbing,” said Director of Health Protection Jim Craig.

Members of Voting Rights for All MS and the state chapter of the ACLU gathered on the second-floor rotunda inside the Capitol today at 1 p.m. to demand Gov. Phil Bryant retract recent comments about voter ID that the group believes could mislead voters.

A petition at Signon.org has received more than 1,000 signatures demanding that Gov. Bryant retract statements he made about voters presenting ID at the polls.

The state's voter ID law has not received approval from the U.S. Department of Justice, and therefore is not in effect for tomorrow's election. Voters will be able to vote without any form of photo ID.

The petition came in response to Bryant's comments Oct. 31 after the Mississippi Economic Council's Hobnob.

"If you have to show a ID to buy a pack of cigarettes or to buy alcohol, which you should, then certainly you ought to have to present an ID to vote, so that we are certain that you're not stealing someone else's liberty and their chance to vote," Bryant said.

"We are calling on Gov. Bryant to immediately retract his statements asking for voters to show ID at the polls, and to clarify that there is no voter ID law in effect for the election tomorrow," David Denney of Voting Rights for All MS said at the Capitol. "As the highest elected official in the state, Gov. Bryant should know better than to make such statements, knowing that people listen to what he has to say."

Mississippi ACLU Director of Programs Nancy Kohsin-Kintigh encouraged any voters who are victims of or witness any discrimination, unfair or illegal practices at the polls tomorrow to call the ACLU at 888-354-ACLU (2258).

The petition reads: "Governor Bryant, the people of Mississippi call on you to immediately issue a retraction of your misleading statement to the Mississippi Economic Council calling on voters to present ID at their polling places this election. Furthermore, we call on you to clarify, unequivocally that photo ID is not required at the polls and the Voter ID law will not be in effect for this election on Tues., Nov. 6th. You are elected to represent ALL Mississippians and your actions are plain wrong, bordering on dereliction of your constitutional duty."

Jackson Public Schools will see a $3.63 million increase in funding from the city in the upcoming school year.

Jackson developer David Watkins is apparently not satisfied with losing control over the Farish Street renovation project, and is asking the Jackson Redevelopment Authority Board to reconsider their decision of two weeks ago to cut ties with the Farish Street Group, of which Watkins is the chief investor and developer.

The developer of the Farish Street entertainment district, Watkins Development LLC, has requested that the Jackson Redevelopment Authority (J.R.A.) reconsider their recent decision to cancel the leases and parcels in that area, where Watkins has spent millions of dollars on the historic urban renewal project. In a 10 page letter to the J.R.A., copied to the bulk of City government, Watkins legal counsel, Lance Stevens of Jackson, presents a lengthy historical account of the company’s accomplishments and unforeseen obstacles on the project, as well as the financial fallout which would accompany the developer’s ouster.

That letter is attached.

“We are encouraged by the new vision that Mayor Lumumba has brought to Jackson and feel certain that he will demand reconsideration of J.R.A.’s acts when our company is finally allowed to make a public or private presentation,” says David Watkins, the managing partner of Watkins Development.

The letter to J.R.A. references the fact that the leases were cancelled without consultation with Watkins’ group and without any presence at the meeting.

“The J.R.A. appears to be putting our fine city at risk–risk of destroying Farish Street’s hopes and risk of massive legal exposure–with their uninformed decision-making. They must be receiving no credible legal advice whatsoever,” says Watkins’ legal counsel, Lance Stevens. The letter to J.R.A. documents the $4.7 million that Watkins himself has invested in the property, while noting that the City and J.R.A., in particular, have not invested any money, despite scuttlebutt that City funds have been squandered.

“J.R.A. committed over $10 million in financing to the project and has utterly failed to contribute a nickel,” says Stevens. “The good news, however, is that with a timely reversal of their decision, the $5 million in tax credits can be salvaged, a protracted legal battle can be avoided and Farish Street can become our center for entertainment and local entrepreneurship."

The letter to J.R.A. documents that over $5 million in tax credits would be lost if Watkins Development is removed altogether from the project (as well as another $4 million in tax rebates), “dooming” the project, according to their counsel.

The deeply "red" state of Kentucky -- the folks who put both Mitch McConnell and Rand Paul as in Senate (and, excruciatingly, on our TVs) -- is also the only Southern state that has expanded Medicaid in accordance with the Affordable Care Act.

They also implemented their own ACA online exchange, instead of relying on the Feds.

The result?

Kentucky’s experience has been exemplary: In its first day, 10,766 applications for health coverage were initiated, 6,909 completed and 2,989 families were enrolled. Obama himself bragged that Kentucky led the nation with its glitch-minimized performance.

Kentucky's opt-in attitude is the result of their Democratic governor, Steve Beshear, who has done end-arounds on his GOP-lead state Senate and poked his finger in the eye of the Tea Party. Focusing on the moral implications of improving healthcare access for the citizens in his state, Beshear is perfectly willing to tell the national media why he's willing to make ACA compliance a signature accomplishment of his tenure.

“[T]o those more worried about political power than Kentucky’s families, I say, ‘Get over it’…and get out of the way so I can help my people. Here in Kentucky, we cannot afford to waste another day or another life.”

And why is ACA popular in-of-all-places Kentucky? Is it because it gives people an opportunity to buy into their own health security and that of their families? Is it because it's an actual market-based solution -- a Republican idea from a few decades back, polished up and implemented first by Mitt Romney in Connecticut -- that might help lessen the burden on families, small businesses and, ultimately, on state coffers?

Time will tell, but it should be a cautionary tale for "red" state politicians -- such as, oh, Governor Phil Bryant -- who have taken the path of least resistance within their own party and buckled to their Tea Party and Talk Radio constituencies.

If Obamacare works -- especially since it now looks like the GOP is pretty much out of tricks to block it from getting started -- then folks like Phil are going to be on the losing end not just of a moment in political history, but of actually doing the right thing for the citizens of their state.

This week's new releases, plus some thoughts on Paul McCartney's "New"...

An interesting piece in Salon this week seems to have discovered (bless their little San Francisco hearts) that 'open carry' is a "new craze" (ahem) out here in flyover country.

But, now that they've caught on, the piece does take a fascinating look at some of the psychology of open carry and presents a case for the idea that open carry actually contributes to violence instead of curbing it.

How can that be? Here's a couple of the key points they make:

• People with guns tend to see guns, even when they're not there. Result: higher chance of shooting an unarmed "threat."

A recent study published in the Journal of Experimental Psychology suggests that when people are holding a gun, they’re less capable of evaluating a threat than they would be if they didn’t have a weapon in their own hands.

• The presence of a weapon can make a hostile environment more hostile.

Since 1967, researchers have been observing the “weapons effect,” a phenomenon in which the mere presence of a weapon can stimulate aggressive behavior. Of course, a person doesn’t respond to a gun the way a cartoon bull reacts to the matador’s cape; we aren’t spontaneously enraged every time we notice a firearm. But empirical research has repeatedly shown that when people are already aggravated, seeing a gun will motivate them to behave more aggressively.

• Your body responds involuntarily to threats, and the presence of weapons is frequently interpreted as a superior threat in a given environment.

“The ‘threat superiority effect’ is the tendency for people to be able to pick out very quickly in their environment things that might pose a threat to their security — anything that might be dangerous,” explains Isabelle Blanchette, a professor of psychology at the University of Quebec. “People have a tendency to be able to see these things before they see other things.”

Read the whole piece; it'll fly in the face of some people's worldview, but if you've got an open mind about this topic it really is food for thought on the psychology of open carry.

True the Vote, the Houston—Texas-based pollwatching organization that is suing Mississippi political and government officials over alleged voter suppression—has submitted two affidavits from people to support their claims that the integrity of the June 24 Republican primary for U.S. Senate might have been compromised.

One submitted to TTV by a woman named Susan Morse in Noxubee County claims that a Macon woman participated in the GOP primary after voting in the Democratic primary June 3, which state election laws prohibit.

Another, filed in Harrison County by a man named Phillip C. Harding III, claims that at about 2 p.m. on July 1—one week after the election that U.S. Sen. Thad Cochran beat state Sen. Chris McDaniel, he observed election officials discard ballots.

Harding writes: "In a one of the bins I found a small stack of provisional ballots, unopened. I gave te provisional ballots to an exec committee member who took control of them. I also found absentee ballot bags in several o the supply bins. Some had opened envelopes and applications in the them. I took the applications and envelopes out because I did not know what to do with them, but believed they should be saved. After setting them aside I saw another volunteer dispose of them at executive committee members' direction."

The group filed a motion for a temporary restraining order in U.S. District Court in Jackson late Wednesday against election commissioners in several Mississippi counties, including Hinds County, as well as the state GOP. A teleconference took place this morning at the federal courthouse.

The motion for the TRO detailed the counties it says is not complying with the law: While some counties provided proper voter records, Copiah County, Hinds County, Jefferson Davis County, Lauderdale County, Leake County, Madison County, Rankin County, Simpson County, and Yazoo County refused. These counties, who have been sued via their respective Election Commissions, also wrongfully maintain that the birthdates of voters must be redacted from voter records, at Plaintiffs’ expense."

U.S. District Judge Henry Wingate has dismissed a federal lawsuit over conditions at Oakley Youth Development Center.

According to a press release, Mississippi Department of Human Services officials credit the ruling with the agency's efforts to "better the conditions for all youth adjudicated delinquent and assigned to Oakley through Mississippi youth courts."

“The Division of Youth Services has worked to improve conditions and education, while ensuring the safety and security of youth at Oakley,” said MDHS Executive Director Richard Berry. “We appreciate the Department of Justice and the federal court’s affirming the progress and advances made for youth in state custody.”

Gov. Phil Bryant also weighed in, through the release, saying: “I want to thank Richard Berry and the Mississippi Department of Human Services for working hard over the last nine years to bring conditions to their current levels at the Oakley Youth Development Center. The diligence of their staff to meet the many compliance issues is apparent, and they have succeeded in improving the center drastically from where it was from almost a decade ago.”

In 2003, the U.S. Department of Justice conducted an investigation of Oakley and the now-closed Columbia Training School in response to three federal lawsuits alleging abuses ranging from staff forcing students to eat their own vomit, to hog-tying students and leaving them naked in dark cells for days at a time. The DOJ successfully sued Mississippi to correct the brutal treatment of inmates and the deplorable conditions of the facilities in 2005, and had worked with the DHS to devise and implement a plan of action.

DHS added: "In 2010 the state had met 51 of those requirements, and an amended agreement was entered into by all parties. Earlier this year the federal monitor assigned to the case found that OYDC had maintained substantial compliance with the 23 remaining provisions for a significant period of time. As a result of that report, DOJ and the State of Mississippi filed to dismiss the suit.

"Numerous changes have occurred at Oakley since 2005. Expansion of medical and dental services, better mental health care, and an updated education program accredited by Mississippi Department of Education are just a few of the programs now successfully operating at facility. Although DYS has had numerous challenges to overcome, the division has accomplished its goal of meeting the requirements of the lawsuit."
