Court Confirms: DOMA Unconstitutional

The 2nd U.S. Circuit Court of Appeals in Manhattan today upheld a lower-court ruling that found the Defense of Marriage Act is unconstitutional. Passed in 1996, DOMA defines marriage as being between one man and one woman, and denies (among other things) federal recognition and benefits to same-sex couples.

“Today’s decision affirms that DOMA deprives same sex couples of equal protection under the law,” New York City Mayor Michael Bloomberg told the city's http://newyork.cbslocal.com/2012/10/18/new-york-appeals-court-strikes-down-defense-of-marriage-act/">CBS affiliate. “This ruling is an important step in ensuring the rights of men and women are not dependent upon who they love and who they chose to spend their lives with. We have much more to do, but we are another step further on the road to a more perfect union for all Americans.”

Lawyers expect this case to reach the U.S. Supreme Court.
